On May 8, 2026, the Cyberspace Administration of China, the National Development and Reform Commission, and the Ministry of Industry and Information Technology jointly released the Implementation Opinions on the Standardized Application and Innovative Development of Intelligent Agents. The document sets out how China intends to guide, standardize, and govern intelligent agents: AI systems capable of autonomous perception, memory, decision-making, interaction, tool use, and task execution.
Unlike earlier rules that focused mainly on generative AI, content moderation, model filing, and data compliance, this framework treats AI agents as a distinct category of technology. The policy recognizes that agents are not merely chatbots that generate text or images. They are systems that can act on behalf of users, coordinate with other systems, use tools, execute tasks across platforms, and potentially operate in both digital and physical environments.
The framework is designed to promote both innovation and control. It aims to strengthen China’s AI industry while ensuring that agentic systems remain safe, controllable, reliable, trustworthy, and aligned with existing laws, regulations, ethics, and social governance priorities. In practical terms, the policy calls for standards covering agent technologies, products, data exchange, application scenarios, quality evaluation, security assurance, and trustworthy certification.
One of the most important parts of the framework concerns decision-making authority. The document proposes distinguishing between actions that must remain under direct human control, actions that can be delegated to AI with user authorization, and actions agents may perform autonomously. It also stresses that users should retain the right to know what an agent is doing and the final authority over important decisions.
The policy also places strong emphasis on behavioral controls. Regulators want developers to build guardrails into agent systems so that they operate lawfully and remain within authorized boundaries. The document highlights the need for traceability, risk warnings, permission management, abnormal behavior detection, and mechanisms to intervene when agents behave improperly or create security risks.
Another major focus is the creation of standards and protocols for what the document describes as an “Intelligent Internet.” This includes research into agent registration platforms, digital identities for agents, capability declarations, interoperability protocols, trusted connections, compliant payments, and conflict resolution between agents. It warns against agents using human-like interaction techniques to encourage addiction, emotional dependency, manipulative consumption, or harmful behavior, particularly among minors and elderly users. Industry observers suggest that the policy is not only about safety. It is also a strategic effort to strengthen domestic technological leadership. By developing standards for agent frameworks, interoperability, evaluation, security, and certification, China is trying to shape the infrastructure on which future AI products and services will be built. The document also emphasizes domestic controllability, including support for open-source frameworks, domestic operating systems, compatible chips, and participation in international standards-setting.
Implications of China’s Algorithmic Governance
The establishment of this framework comes at a time of growing international competition over AI governance and technical standards. While many Western debates focus heavily on frontier AI safety, catastrophic risk, and voluntary industry commitments, China’s approach is more focused on deployment, industrial integration, social governance, and maintaining control throughout the AI lifecycle.
The policy proposes a tiered and classified governance model based on application scenarios and potential risks. High-risk uses in sensitive sectors such as healthcare, transportation, media, public security, finance, government services, judicial systems, energy, and other key industries may face stronger requirements, including filing, testing, certification, oversight, product recalls, and compliance reviews. Lower-risk uses, such as entertainment or office productivity, are expected to rely more on self-assessment, platform governance, reporting systems, and industry self-regulation.
For multinational companies operating in China, the framework could require significant changes to product design and compliance workflows. AI agent products may need stronger user authorization systems, better logging, privacy protections, traceability mechanisms, and clearer limits on what agents are allowed to do. Companies working in sensitive industries may face higher market-access costs because they will need to demonstrate not only technical capability but also safety architecture, compliance documentation, testing results, and accountability mechanisms.
The framework is also likely to encourage investment in specialized software, evaluation systems, monitoring tools, and security infrastructure for AI agents. As developers work to satisfy requirements for reliability, explainability, behavioral control, and compliance, demand may grow for tools that can audit agent behavior, detect abnormal actions, verify permissions, and monitor how agents interact with users and other systems.
China’s new policy framework for AI agents represents a deliberate attempt to shape the future of artificial intelligence before agentic systems become deeply embedded in society.
